Exclusion Orders
It has recently come to the Committee's notice that some courts are unable to provide a prompt service. As it is preferable for the draft lease to be appended to the order should be extremely similar to the lease to be granted the court application cannot usually be made until final lease terms have been agreed. Often there is then great urgency to get an order so that the lease can be completed. Some members have reported some courts taking up to 2 weeks or more to produce orders. This is not acceptable to many clients who just do not understand the delay.
CPR Part 56 makes it clear that the High Court or any county court can now issue an order. Where are the most efficient courts offering a prompt service?
