PLA Law Reform Committee – Request for members feedback: Consultation on Extending Fixed Recoverable Cases in Civil Cases

 

Following the voluntary Capped Costs Pilot which commenced in certain Business and Property Courts on 14 January 2019, MOJ has launched a consultation in relation to extending the use of Fixed Recoverable Cases (FRC) in Civil Cases. This follows recommendations made in Sir Rupert Jackson’s Supplemental Report on FRCs in July 2017.

The consultation is seeking interested parties’ views on the extension of FRC to (1) fast track cases and (2) intermediate cases being cases valued between £25,000 and £100,000.
