Extending Fixed Recoverable Costs in Civil Cases – Response to consultation from the Property Litigation Association

 

Following the voluntary Capped Costs Pilot which commenced in certain Business and Property Courts on 14 January 2019, earlier this year MOJ  launched a consultation in relation to extending the use of Fixed Recoverable Cases (FRC) in Civil Cases. This follows recommendations made in Sir Rupert Jackson’s Supplemental Report on FRCs in July 2017.  The consultation sought interested parties’ views on the extension of FRC to (1) fast track cases and (2) intermediate cases being cases valued between £25,000 and £100,000.  https://consult.justice.gov.uk/digital-communications/fixed-recoverable-costs-consultation/.  Following a request for feedback from PLA members, click here for the LRC’s response to the consultation.
