Luke Molyneux, Richard Morris
and Michael Cunningham of Malcolm Hollis will discuss how legal obligations are dealt with on the ground and the difficulties surveyors face in dealing with dilapidations claims.   The talk will include sections on:

  • Market Trends – recent trends in schedule contents, claim values, proportional split between covenants, and time taken to conclude settlements;
  • Reinstatement – including the interpretation of covenants, licences for alterations and associated documentation and requirements to yield up with vacant possession (including Malcolm Hollis’s thoughts on Riverside Park v NHS and its consequences);
  • Refurbishments, Supersession and MEES – how landlords’ MEES obligations during refurbishments might affect dilapidations claims and thoughts on tactics for both landlords and tenants;
  • Section 18(1) – including thoughts on its popularity as a defence, misconceptions and when it is best used; and,
  • Innovation – how PropTech can be used to assist with claims.
